Terms of Service

These Terms of Service ("Terms") govern your use of the primerisingyou.com website and your purchase of coaching programs from Marlon Peralta, doing business as Prime Rising and Peralta Capital ("Prime Rising," "we," "I"), operated by Dr. Marlon Peralta, PharmD. By using this site or purchasing a program, you agree to these Terms. Enrolled clients also sign a separate Services Agreement. If the two conflict, the signed Services Agreement controls.

1. What we provide

Prime Rising provides metabolic training and nutrition coaching for fat loss, body composition, and longevity, together with pharmacology education. Depending on the product purchased, this includes bloodwork interpretation in the context of optimization, education on how peptides, hormones, and related compounds work, training programming, nutrition planning, weekly check-ins, and, for the Phone / Zoom Consultation, a scheduled call. Products are: the Email Consultation, the Phone / Zoom Consultation, the Custom Nutrition Plan, the Nutrition + Training Plan, Metabolic Ascension coaching (billed monthly), and Apex (a twelve-month engagement, paid in full). 2. What we do not provide

• We do not sell, ship, prescribe, dispense, or supply any medication, peptide, hormone, supplement, or other compound. Any compound you use is obtained by you, through your own medical provider or licensed pharmacy, at your own discretion.
• We do not provide medical diagnosis, treatment, or prescriptions. The coach is a licensed pharmacist but is not acting as your dispensing pharmacist, physician, or prescribing clinician.
• Pharmacology content is general education: how a class of compound works, what published research shows, and what a laboratory marker means. It is provided so that you can have an informed conversation with your own prescriber, who remains responsible for any prescription.
• We do not order or pay for laboratory testing. You obtain bloodwork through your own provider or a lab service of your choice.

Coaching content is educational. You remain responsible for your own medical decisions and should maintain a relationship with appropriate medical providers for prescriptions and medical oversight.

3. Eligibility

You must be at least 18 years old, located in the United States, and legally able to enter a binding contract. By purchasing, you confirm the information you provide in your intake is accurate and complete.

4. Pricing and payment

• Prices for consultations and plans are listed in US dollars (USD) on the Programs & Pricing page. Metabolic Ascension coaching is billed monthly at the rate set on the strategy call, with a 16-week minimum term. Apex is $16,200 USD paid in full. Both are confirmed in writing in the Services Agreement before any payment is taken.
• Payment is by credit or debit card and is processed by Stripe. We do not store your full card number. Charges appear on your statement as PERALTA CAPITAL, the registered name on our payment account; Prime Rising is the trade name used on this site.
• Monthly coaching is billed automatically every 30 days for the term stated in your Services Agreement (minimum 16 weeks). You authorize these recurring charges when you enroll.
• Prices may change for future enrollments. The price you pay is the price shown when you enroll.

5. Program term and delivery

All deliverables are digital and are sent by email or shared document. Email consultations are delivered within 5 business days of your completed intake. Phone / Zoom consultations are scheduled within 7 days of purchase, with a written summary within 3 business days after the call. Custom plans are delivered within 7 days of our receipt of your completed intake form. Coaching runs for the length agreed on the strategy call and stated in the Services Agreement (minimum 16 weeks; twelve months for Apex), and the personalized program is delivered within 7 days of our receipt of your completed intake. 6. Client responsibilities

Coaching and plans depend on your data. You agree to:

• Complete the intake form (and, for coaching, sign the Services Agreement) before design begins.
• Complete weekly check-ins and keep your tracking current (coaching).
• Obtain bloodwork at the agreed intervals (for coaching, at baseline and then every 6 to 12 weeks) and share results.
• For the Phone / Zoom Consultation, attend the scheduled call or reschedule with at least 24 hours notice.
• Report adverse effects, new medications, or medical changes promptly.

If coaching check-in data is incomplete or more than 3 days late, program adjustments may be postponed until complete data is provided. Consistent non-compliance may result in termination of the program without refund.

7. Refunds and cancellation

Refunds and cancellations are governed by our Refund & Cancellation Policy, which is part of these Terms.

8. Health and safety disclaimer

• Peptides, hormones, and performance compounds carry risks, including side effects, interactions, and individual variation in response.
• The coach provides education, training and nutrition guidance, and lab interpretation for optimization purposes only. The coach is not responsible for injuries, adverse reactions, medical complications, or lack of results.
• Any prescription, and any decision to use, continue, change, or stop a prescribed medication, is made with your own licensed prescriber.
• You have been advised to work with licensed medical professionals for prescriptions and medical monitoring, and you agree to do so.
• Results vary. No specific outcome is guaranteed.

9. Intellectual property

All programs, plans, educational materials, tracking systems, templates, and frameworks provided to you remain the property of Prime Rising and Marlon Peralta, PharmD. They are licensed to you for personal use during and after your program. You may not share, resell, reproduce, or distribute them. Violation may result in immediate termination without refund.

10. Termination

We may terminate a program or plan immediately without refund if you provide false intake information, consistently fail to complete check-ins or tracking, use materials in violation of Section 9, or behave in a way that is abusive or unsafe. You may terminate at any time with written notice to marlon@primerisingyou.com. Early termination by you does not entitle you to a refund of fees already paid. No refunds are issued after your intake form has been completed and sent, because protocol design will have commenced. See the Refund & Cancellation Policy.

11. Testimonials and media

We will not publish your name, likeness, results, or testimonial without your written consent, which you may give or withhold in the Services Agreement.

12. Limitation of liability

To the fullest extent permitted by law, Prime Rising's total liability for any claim arising from the program or this site is limited to the amount you paid for the program. We are not liable for indirect, incidental, or consequential damages.

13. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at marlon@primerisingyou.com and allow 30 days to resolve the issue in good faith.

14. Changes to these Terms

We may update these Terms from time to time. The date at the top shows the latest revision. Changes do not affect a program you have already purchased.
